1. Acceptance of Terms

By accessing or using DayHop at https://dayhop.ie (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms form a legally binding agreement between you and the operator of DayHop. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

DayHop is an online platform that helps families in Ireland discover and track kid-friendly activities. The Service allows users to:

  • Browse a curated database of kid-friendly locations across Ireland
  • Mark activities as visited and track family outings
  • Create and share household accounts with family members
  • Plan trips and outings
  • Suggest new activities for inclusion in the database

3. User Accounts

Some features of the Service require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your account credentials secure and confidential
  • Notify us immediately at help@tnkng.com if you suspect unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 16 years old to create an account. If you are under 18, you confirm that a parent or guardian has consented to these Terms on your behalf.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Post false, misleading, or defamatory content
  • Infringe the intellectual property rights of any third party
  • Transmit spam, malware, or other harmful code
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Scrape, harvest, or systematically collect data from the Service without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity

5. User-Submitted Content

When you submit content to the Service (such as activity suggestions, trip names, or household names), you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, and moderate that content for the purposes of operating the Service.

You are responsible for the accuracy and legality of any content you submit. We reserve the right to remove content that violates these Terms or that we consider inappropriate, without notice.

EU Digital Services Act (DSA): DayHopqualifies as a “micro or small” provider under Regulation (EU) 2022/2065 (DSA) and is not subject to the obligations that apply to very large online platforms. We nonetheless maintain a moderation process for user-submitted content and will act on valid notices of illegal content. 6. Intellectual Property

The DayHop name, logo, website design, activity database, and all related intellectual property are owned by or licensed to the operator of DayHop. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

Activity listings in our database may include publicly available information about third-party venues. We do not claim ownership of those venues or their names.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Activity information in our database is provided for general informational purposes only. We do not guarantee the accuracy, completeness, or current availability of any listed activity. Always verify details directly with the venue before visiting.

We do not endorse or take responsibility for the content, safety, or suitability of any third-party venues or activities listed on the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the operator of DayHop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed €100 or the amount you paid us in the twelve months prior to the claim, whichever is greater.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law under Irish or EU consumer protection legislation.

10. Indemnity

You agree to indemnify and hold harmless the operator of DayHop and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or your violation of these Terms.

11. Third-Party Links

The Service may contain links to third-party websites or services. These links are provided for convenience only. We are not responsible for the content, privacy practices, or terms of any third-party sites and we encourage you to read their terms and privacy policies.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, without notice, if we believe you have violated these Terms or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, 9, 10, 13, 14, and 15 of these Terms survive termination.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the EU, you also benefit from mandatory consumer protection provisions of the law of the country in which you reside, and you may have the right to bring proceedings in your local courts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date above. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
